“Surrey Six Murderer’s Conviction Appeal Denied”

Must Read

A request made by one of the individuals responsible for the Surrey Six murders to dismiss his convictions has been denied by a judge in the B.C. Supreme Court. Justice Martha Devlin concluded that the claims of misconduct by Cody Haevischer against law enforcement officials were insufficient to warrant dismissing the case against him. Consequently, Haevischer’s six murder convictions and a conspiracy charge have been formally recorded, resulting in a life sentence for him.

Following his 2014 conviction in the Surrey Six case, Haevischer sought to halt the legal proceedings, alleging police misconduct and mistreatment while in custody constituted an abuse of process. Despite his plea for a reduced sentence, the judge, after careful consideration, rejected most of Haevischer’s claims, acknowledging only a breach of his Charter rights due to solitary confinement.

The ruling by Justice Devlin comes after a complex legal journey stemming from the 2007 murders. Haevischer, along with co-accused Matthew Johnston, faced charges in 2009. Despite a prior dismissal of their application, the convictions were later overturned, leading to a lengthy legal battle that eventually culminated in Devlin’s recent decision.

The ruling was met with emotion from victims’ families present in the courtroom, with Eileen Mohan, whose son was among the innocent victims, expressing relief at the verdict. Devlin emphasized the gravity of the case, highlighting the heinous nature of the murders and underscoring the irrefutable evidence against Haevischer.

In her assessment, Devlin examined whether Haevischer’s complaints of police misconduct and treatment in custody constituted an abuse of process that would compromise his right to a fair trial. Despite acknowledging some breaches, the judge ultimately determined that the severity of the crimes warranted the convictions, dismissing the majority of Haevischer’s claims.

The Surrey Six murders, a tragic event that shook the province, were characterized by ruthless violence and targeted killings. Devlin’s ruling underscores the gravity of the crimes committed and the necessity of upholding justice in such cases, ensuring accountability for those responsible.
