CMA Probes Online Pricing Tactics of Major Companies

Concerns regarding the online pricing practices of eight companies have sparked investigations, with an additional 100 businesses on track to receive warnings. The firms under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.

The Competition and Markets Authority (CMA) is focusing its investigations on the presentation of fees online, potential misrepresentation of time-limited offers, and the possible automatic opt-in of customers for optional charges. Specific areas of concern include additional charges on ticket selling websites like StubHub and Viagogo, fee transparency on driving school websites like AA Driving School and BSM Driving School, as well as the handling of one-off joining fees for annual memberships by Gold’s Gym.

Wayfair is being scrutinized for time-limited sales practices, Marks Electrical for default opt-ins, and Appliances Direct for their use of time-limited sales and default opt-ins. The CMA emphasized that while these companies are under investigation for potential breaches of consumer law, no final decisions have been made yet.

This move by the CMA marks the first instances of investigations leveraging their consumer protection powers. Additionally, the CMA plans to correspond with 100 other businesses to address concerns over their use of additional fees and sales tactics.

Sarah Cardell, the CEO of CMA, stressed the importance of ensuring transparent pricing and fair deals for consumers across various industries. She highlighted the watchdog’s commitment to taking action against misleading practices and illegal pressure selling to protect consumer interests and promote fair business practices.

In response to the investigations, an AA Driving School spokesperson affirmed their transparency regarding booking fees and their readiness to enhance customer notifications. Viagogo also expressed cooperation with the CMA’s investigation process.

The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. Notably, BSM Driving School is affiliated with the AA, while Viagogo and StubHub share the same parent company.
